Understanding, Reporting and Responding to Sexual Harassment

Too often we think of sexual harassment primarily as a legal problem. In truth, many organizations would not consider addressing the issue in a systematic way unless faced with the threat of a lawsuit. This program, however, starts with the premise that sexual harassment is wrong, even if it were not illegal. We do review the law, helping participants to understand how it applies in situations which we might reasonably expect would occur in the workplace. The review of the law includes the distinction between cases involving quid pro quo harassment and cases revolving around the creation of a hostile working environment.

The course also addresses issues related to reporting and responding to harassment when it is alleged or suspected to have occurred. We take a risk management approach to identifying the appropriate response. That approach will allow us to distinguish between levels of response that are consistent with the Chinese proverb: "Do not use an axe to remove a fly from your forehead." On the other hand, the group will consider those circumstances under which an aggressive investigatory response would be appropriate.
